Privacy Policy

1. Introduction

MEMO ("MEMO," "we," "us," "our") is a South African study platform for Grade 10–12 learners. We are committed to protecting your privacy and providing a secure experience. This Privacy Policy governs how we collect, use, maintain, and disclose information collected from users ("User," "you") of mymemo.co.za and the MEMO app (together, the "Site").

Because many of our Users are minors, this Policy explains, separately in Section 4, how we handle children's personal information under South Africa's Protection of Personal Information Act (POPIA).

2. Information We Collect

a) Personal identification information. Name, email address, mailing address, phone number, grade, and subjects. Where a User is under 18, we also collect a parent or guardian's name and contact number, as part of the account consent process. Users may browse the Site anonymously; we only collect personal information Users voluntarily submit.

b) Non-personal identification information. Browser type, device type, operating system, and general connection information (e.g. Internet service provider), collected automatically whenever a User interacts with the Site.

c) Learner activity information. Subjects studied, grade, AI tutor conversations, practice-paper activity, and study progress. This is used to personalise the tutor's responses and study content to the individual learner. See Section 6.

3. Payment Information

Payments are processed by PayFast, our third-party payment processor. Card and payment details are submitted directly to PayFast and are not stored on MEMO's own servers. This information is used solely to process your subscription payment.

4. Children's Information & POPIA

MEMO's Users are primarily learners in Grade 10–12, many of whom are under 18. Under POPIA, children's personal information is treated as special personal information requiring a heightened basis for lawful processing.

• We rely on parent/guardian consent, captured at signup, as the lawful basis for processing a minor User's personal information.

• MEMO designates an Information Officer responsible for POPIA compliance: Zaheed Naidoo.

• Users (or their parent/guardian) may contact us at any time to access, correct, or request deletion of a learner's personal information. See Section 10.
  
  

5. How We Use Collected
Information

• To process transactions and subscriptions: Explorer (free), MEMO Annual, MEMO Monthly, and Founding Schools accounts.

• To operate the AI tutor. See Section 6.

• To send transactional communications: order/subscription confirmations, renewal notices, exam countdown alerts, and responses to inquiries.

• We do not use your information for any purpose beyond what's described in this Policy without your consent.
  
  

6. AI Tutor & Third-Party AI Processing

MEMO's AI tutor is powered by Google's Gemini API,. Your conversations are not used by Google to train their models and are not reviewed by human reviewers as part of Google's standard product-improvement process.

7. How We Protect Your Information

We use appropriate technical and organisational measures, including encrypted connections, access controls, and secure hosting, to protect against unauthorised access, alteration, disclosure, or destruction of your personal information.

8. Sharing Your Personal Information

We do not sell, trade, or rent Users' personal identification information. We share information only with the service providers necessary to operate MEMO:

• PayFast: payment processing

• Google (Gemini API): AI tutor processing

• Supabase: application hosting and data storage

We may share aggregated, non-identifying demographic information with business partners for the purposes described in Section 5.

9. Cookies

MEMO's Site may use cookies to enhance your experience, for example to keep you logged in and remember your preferences. Your browser lets you refuse cookies or alert you when they're being set; if you do, some parts of the Site may not function properly.

10. Your Rights

Under POPIA, you (or, for a minor User, their parent/guardian) have the right to:

• Access the personal information we hold about you

• Request correction of inaccurate information

• Request deletion of your information, subject to our legal obligation to retain certain records (e.g. payment records)

• Object to processing of your information

• Lodge a complaint with the Information Regulator (South Africa): inforegulator.org.za

To exercise any of these rights, contact us using the details in Section 13.

11. Data Retention

We retain your personal information for as long as your account remains active, or as needed to comply with our legal obligations, resolve disputes, and enforce our agreements.

12. Changes to This Policy

MEMO may update this Privacy Policy at any time. When we do, we will update the effective date at the top of this page. We encourage Users to review this page periodically. It is your responsibility to stay informed of changes.
